Booth Policy

1. Purpose

This Booth Policy establishes the terms and conditions for exhibitors and sellers ("Participants") who reserve and operate booths at events organized, hosted, or supported by Eventorian. By participating, all exhibitors and sellers agree to abide by this policy.


2. Compliance with Laws and Licenses

  • All Participants must ensure full compliance with all applicable laws, regulations, and ordinances relevant to their products, services, or activities.
  • Participants are solely responsible for obtaining and maintaining all licenses, permits, and certifications required for their products or services.
  • Eventorian reserves the right to request documentation of licenses, permits, or certifications at any time. Participants are obligated to provide such documentation promptly.
  • Failure to comply with licensing requirements may result in removal from the event without refund and do not make Eventorian liable.

3. Insurance Requirement

  • All Participants are required to obtain and maintain appropriate insurance coverage, including but not limited to:
    • General liability insurance
    • Product liability insurance (if applicable)
    • Workers’ compensation insurance (if applicable)
  • Participants must provide proof of insurance upon request from Eventorian. Failure to do so may result in denial of booth access or removal from the event.

4. Assumption of Risk and Liability

  • By participating in the event, Participants acknowledge and accept all risks associated with their booth operations, including but not limited to:
    • Damage to or theft of their property
    • Liability arising from interactions with attendees, other exhibitors, or event staff
    • Risks inherent to the event location, environment, or activities
  • Eventorian is not liable for any losses, injuries, damages, or claims arising from booth operations, regardless of cause.
  • Eventorian's maximum liability is limited only to the amount of money that it received from selling/renting that booth or table.

5. Waiver of Liability and No Right to Sue

  • Participants voluntarily waive, release, and forever discharge Eventorian, its affiliates, employees, agents, contractors, and event partners from any and all claims, liabilities, actions, or demands arising out of or in connection with their participation in the event, including but not limited to:
    • Personal injury or property damage
    • Loss of sales or revenue
    • Regulatory or legal actions due to non-compliance with laws
  • This waiver extends to claims based on negligence, breach of duty, or any other grounds to the fullest extent permitted by law.
  • Participants explicitly agree to forgo any legal action or lawsuit against Eventorian in connection with their booth operations.

6. Participant Responsibilities

  • Setup and Operations:
    • Participants are responsible for setting up, operating, and dismantling their booths within the timelines and guidelines provided by Eventorian.
    • Booth areas must be kept clean, safe, and compliant with fire and safety regulations.
  • Product Safety and Quality:
    • Participants are solely responsible for the safety, legality, and quality of the products or services they offer.
    • Eventorian does not endorse or guarantee any product or service provided by Participants.
  • Documentation:
    • Participants must provide proof of licenses and insurance upon request. Eventorian does not assume responsibility for verifying compliance with regulatory requirements.

7. Indemnification

  • Participants agree to indemnify and hold harmless Eventorian, its affiliates, employees, agents, contractors, and event partners from any claims, liabilities, damages, or expenses (including attorney fees) arising from:
    • Booth operations or activities
    • Failure to comply with legal requirements
    • Injuries or damages caused by Participants, their products, or their staff

8. Booth Assignment and Usage

  • Booth locations are assigned at the sole discretion of Eventorian and may be subject to change.
  • Subletting, sharing, or transferring booth space without prior written approval from Eventorian is prohibited.
  • Participants must use their booths only for the purpose(s) described in their application and must not engage in any illegal, disruptive, or unauthorized activities.

9. Cancellation and Removal

  • Eventorian reserves the right to cancel or deny booth access to any Participant who fails to comply with this policy or engages in activities deemed harmful, disruptive, or unsafe.
  • Refunds for cancellations are at Eventorian’s sole discretion and may exclude fees.

10. Event Cancellation or Force Majeure

  • Eventorian is not liable for any losses or damages incurred by Participants due to event cancellation, postponement, or modification resulting from circumstances beyond Eventorian’s control, including but not limited to acts of God, government actions, pandemics, strikes, or natural disasters.

11. Media and Photography Release

  • By participating in the event, Participants consent to being photographed, filmed, or recorded and grant Eventorian the right to use such media for promotional, marketing, or other purposes without compensation.

12. Amendments to Policy

  • Eventorian reserves the right to update or modify this policy at any time without prior notice. Updates will be communicated via Eventorian’s official channels.

13. Governing Law

  • This policy is governed by the laws of Ontario, Canada. Any disputes arising out of this policy or the event will be resolved exclusively in the courts of Ontario, Canada.
